Yesterday, President Donald Trump issued an Executive Order (EO) that directs the Departments of Treasury, Labor, and Health and Human Services to review and potentially revise previous guidance concerning several matters related to health insurance plans. At this time, no Affordable Care Act (ACA) regulations are affected. (NAHU) The Agencies would need to take regulatory action before any ACA policies would change.

September 30 is a crucial deadline for the GOP. It marks the last day that Senators could pass a bill through the “fast track” budget reconciliation process. Surprise! After several ACA repeal-and-replace bills did not succeed earlier in the year, ACA repeal now has a real chance of passing by the end of this month. With their newest Graham-Cassidy bill, GOP Congress members make a final effort to repeal and replace the ACA before the September 30 deadline hits. Authors of the bill, Senators Bill Cassidy (R-LA) and Lindsey Graham (R-SC) are working to garner support from fellow Senators before a vote next week.

In the wee hours of this morning, the Senate’s vote on the Health Care Freedom Act also known as the “skinny repeal bill” failed. Senators John McCain (R-AZ), Susan Collins (R-ME), and Lisa Murkowski (R-AK) were among those voting against the bill. This defeat came after much deliberation in the Senate during their 20+ hour Vote-a-rama session, dealing a devastating setback to Republican efforts to repeal and replace ACA.

Today the Senate cast a special procedural vote of 51-50 in favor of the Senate being able to continue debate concerning repeal or repeal-and-replace of the Affordable Care Act (ACA). It is important to understand that there was no bill passed as a result of today’s vote, and current ACA law is in effect. One key to this outcome was undoubtedly Senator John McCain’s return after being hospitalized, to cast his vote in favor of continued debate today.
