The Department of Labor (DOL) recently published the Final Rule regarding the DOL Penalties Inflation Adjustment Act Annual Adjustments for 2018 setting forth the inflation-adjusted civil monetary penalties for violations pertaining to health and welfare benefit plans and pension and retirement plans. The 2018 adjustments are effective for penalties assessed after January 2, 2018, with respect to violations occurring after November 2, 2015.

In late August, the Office of Management and Budget approved the DOL’s proposal to extend the transition period for full implementation of the new Fiduciary Rule and related prohibited transaction exemptions by 18 months—from January 1, 2018 to July 1, 2019. The Department of Labor finalized new regulations that would provide additional procedural protections and safeguards for disability claimants. The new disability claims procedure regulations were supposed to take effect on January 18, 2018 and would have applied to disability claims filed on or after January 1, 2018. The DOL recently issued a final rule, however, that will delay the applicability date of the new disability claims procedure regulations by 90 days—to April 1, 2018.
